Regulation EC 1005/2009 outlines rules on the production, import, export, placing on the market, use, recovery, recycling, reclamation, and destruction of substances that deplete the ozone layer, on the reporting of information related to those substances, and on the import, export, placing on the market, and use of products and equipment containing or relying on those substances.

The regulation was amended in February of 2011. The updated list is found in the PDF “Indicative list of substances controlled under Regulation (EC) No 1005/2009”. http://ec.europa.eu/clima/policies/ozone/docs/substances_en.pdf Controlled substances are listed in Annex I, which is sorted into nine subgroups according to chemical type [i.e. CFCs, halons, HBFCs, HCFCs, etc.] The list includes all isomers and mixtures as well as virgin, recovered, and reclaimed substances. New Substances as of January 1, 2010 are listed in Annex II, which is split into two parts: New substances restricted under Article 24(I) of EC 1005/2009 and Substances to be reported under Article 27 of EC 1005/2009.

Each sublist is further broken down in the CML according to ozone depletion potential thresholds:

  • Ozone depleting chlorofluorocarbons and halons: ODP 0.6 and up
  • Carbon tetrachloride and methyl bromide: ODP 0.6 and up
  • Hydrobromofluorocarbons: ODP 0.3 and up
  • Hydrochlorofluorocarbons: ODP 0.2 and up
  • Hydrochlorofluorocarbons: ODP less than 0.2
  • Trichloroethane and bromochloromethane: ODP 0.2 or less
  • Substances to be reported under EC 1005/2009 Article 24(1)
  • Substances to be reported under EC 1005/2009 Article 27
